Terms of Service

BodyArc LLC — Effective Date: July 13, 2026

1. Agreement

These Terms of Service ("Terms") are an agreement between you and BodyArc LLC, a Wyoming limited liability company ("BodyArc," "we," "our," or "us"), governing your use of the BodyArc applications and websites (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. The Service is not directed to children, and we do not knowingly allow accounts for anyone under 18.

2. The Service

BodyArc is an AI personal trainer: adaptive training programs, an AI coach, photo-based food logging, nutrition and body-composition tracking, and progress analytics. Parts of the Service are generated by artificial-intelligence systems.

3. Not Medical Advice — Health & Safety

THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Coaching, training programs, nutrition estimates, and any other output of the Service — including output generated by AI — are general fitness and wellness information for educational purposes only. They are not a substitute for the advice of a physician or other qualified health provider.

• Consult a doctor first. Talk to your physician before starting any exercise or nutrition program, especially if you have a medical condition, are pregnant, are taking medication, or have any concern about your health.
• AI output can be wrong. AI-generated coaching and nutrition estimates may be inaccurate or incomplete. Do not rely on them as your sole basis for health decisions.
• Assumption of risk. Physical exercise carries inherent risks, including injury. You voluntarily assume all risks associated with your training, and you are responsible for exercising within your own limits.
• Results are not guaranteed. Individual results vary; we make no promise of any particular fitness, weight, or health outcome.
• Emergencies. The Service is not for emergencies. If you experience pain, dizziness, shortness of breath, or any concerning symptom, stop and seek medical help immediately.
• Safety boundaries. The Service is designed not to coach continued weight loss beyond healthy limits; these safety behaviors are a feature of the product and part of these Terms.

4. Subscriptions, Trials, and Billing

Parts of the Service require a paid subscription ("BodyArc Pro"). Current plans are shown at purchase: $216 per year (annual) or $20 per month (monthly).

• Free trial. New subscriptions start with a 3-day free trial. A payment method is required; you are not charged during the trial.
• Automatic renewal. When the trial ends, your subscription begins and your payment method is charged for the plan you selected. Subscriptions renew automatically at the then-current price for your plan until you cancel.
• Cancellation. You can cancel online at any time, in one click, from Billing → Manage subscription (purchases made through the Apple App Store are canceled in your App Store subscription settings). Cancellation stops future renewals; your access continues through the period already paid.
• Refunds. Except where required by law, payments are non-refundable; when you cancel, you keep access for the remainder of the paid period. App Store purchases follow Apple's refund process.
• Price changes. We will notify you before a renewal price increase takes effect, with the opportunity to cancel first.
• Consent records. We retain a record of your consent to these renewal terms as required by law.

5. Accounts

You agree to provide accurate account information and to keep your credentials confidential. You are responsible for activity under your account. You can delete your account at any time in the app; deletion removes your personal data as described in our Privacy Policy.

6. Acceptable Use

You agree not to: use the Service unlawfully; probe, disrupt, or attempt unauthorized access to the Service or its systems; reverse engineer or extract source code except where the law permits; abuse, overload, or resell the Service; upload malicious code; or misuse AI features to generate content that is unlawful or harmful.

7. Your Content and License to Us

You own the content you submit (including food and progress photos and logged data). You grant BodyArc a limited license to host and process that content solely to provide and improve the Service — for example, sending a food photo to our AI provider to estimate nutrition. We do not sell your content or use your health data for advertising.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by BodyArc LLC or its licensors and is protected by intellectual-property laws. These Terms grant you a personal, non-exclusive, non-transferable license to use the Service.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, BodyArc LLC's total liability for any claims arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months before the claim arose, and we are not liable for indirect, incidental, special, consequential, or punitive damages, including personal injury arising from your voluntary participation in physical exercise. Some jurisdictions do not allow certain limitations; those limitations apply only to the extent permitted.

10. Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, and you and BodyArc each waive the right to a jury trial and to participate in a class action. You may opt out of arbitration by emailing support@bodyarc.ai within 30 days of first accepting these Terms. Either party may bring qualifying claims in small-claims court.

11. Changes

We may update these Terms from time to time. If a change is material, we will notify you (for example, by email or in-app notice) before it takes effect. Continuing to use the Service after a change takes effect constitutes acceptance.
